GAZA STRIP - PALESTINE

• Filing Requirements:

1. A power of attorney simply signed and sealed with the official stamp of the applicant Company revealing the exact date of execution.  No notarization or local attestation is now required.

2. A list of the goods and services to be covered by the application.

3. Five prints of the trademark for each class of goods.

N.B:

The trademark application can be filed with a simple copy of the power of attorney provided that theoriginal is submitted within a two months from the date of filing.

Search results need 3-7 working days to be issued.

Official trademark office search covers only word trademarks only.

• Time Frame:

The approximate time frame for completing the registration process of a trademark in Gaza Strip is 12 months.

• Validity:

A trademark registration is valid for seven years from the date of filing the application.

• Notes:

Original power of attorney is required to be submitted within one month from the applications date.

Claiming priority is NOT possible in Gaza.

Services marks may be registered according to the 8th edition of the Nice Classification.

A separate application is to be filed for each class of goods/services.

An application cannot be filed without its complete documents.

An Arabic transliteration is not automatically protected for a trademark in English. The transliteration is protected once registered along with the English word thereof.

• Renewal Requirements:

1. A power of attorney simply signed and sealed with the official stamp of the applicant Company revealing the exact date of execution.  No notarization or local attestation is now required.  

2. Copy of the final registration certificate or last renewal certificate.

• Notes:

The validity of the trademark registration in Gaza is seven years as from the filing date.  Thereafter, a trademark registration is renewable for further consecutive periods of fourteen years each. 

The renewal fees of a trademark registration can be paid during the last 12 months of the current protection period. There is a  one month grace period within which a late renewal application can be filed, but such a late renewal application is subject to the payment of additional fees.

• Requirements for Recordal of Change of name/address/legal status:

1. A Power of Attorney simply signed and sealed with the official stamp of the new name and/address.  No notarization or legalization is now required.

2. The change of name/address recordal can be filed with a simple copy of the power of attorney provided that the original is submitted within two months from the date of filing; however, the trademarks registrar in Gaza is not strict on the submission of the original power of attorney insofar as the simple copy of the same is submitted.

• Requirements for Recordal of assignment, merger, or license:

1. A Power of Attorney simply signed and sealed with the official stamp of the new name and/address.  No notarization or legalization is now required, which should be submitted at the time of fling the change of name/address application and on the payment of the official recordal fees.

2. A Deed of Assignment Duly Notarized.
