Filing Requirements
TURKEY
• Filing Requirements:
A simply signed power of attorney (Required at filing stage).
The name, address, nationality, and occupation of the applicant, and the nature of its business.
A list of the goods and services to be covered by the application.
Eight prints of the mark (not required for word marks)
A certified copy of the priority document must be submitted within three months in case it is claimed.
Search results need 4-7 working days to be issued.
• Time Frame:
The approximate time frame for completing the registration process of a trademark in the Turkey is 12 to 14 months.
• Validity:
A trademark registration is valid for ten years from the filing date.
• Notes:
Services marks maybe registered according to the 10Th edition of the Nice classification
An application should be filed along with a simply signed Power of Attorney.
A transliteration has to be filed in order to be protected.
• Renewal Requirements:
1- A simply signed power of attorney (Required at filing stage).
2- Copy of the final registration certificate or last renewal certificate.
• Notes:
Kindly be advised that, the validity of the trademark registration in Turkey is ten years as from the filing date . Thereafter, a trademark registration is renewable for further consecutive periods of ten years each.
The renewal fees of a trademark registration can be paid during the last 6 months of the current protection period. There is a 6-month grace period within which a late renewal application can be filed, but such a late renewal application is subject to the payment of additional fees. By failing the final due date, the trademark rights will directly lapse.
• Requirements for Recordal of Change of name/address/legal status:
A simply signed Power of Attorney.
A certificate of the change of name or address.
The number and date of registered trademark/service mark.
• Requirements for Recordal of assignment, merger, or license:
A Notarized Power of Attorney signed by the assignee.
A Duly Notarized Deed of assignment signed by the assignor and the assignee, merger document.
The name, address, nationality and profession or nature of business of the assignee.
The number and date of the registered Trademark/service mark.
• Requirements for Recordal of license:
A Notarized Power of Attorney by the licensee.
A Notarized license agreement executed by both parties.
The name, address, nationality and profession or nature of business of the licensee.
The original Trademark certificate for endorsement purposes.
