Filing Requirements

PAKISTAN

• Filing Requirements:

  1. Name, address and nationality/domicile of the applicant.

  2. Filing date, number and country of filing (for priority applications only)

  3. Ten specimen of the mark (not needed for the word mark)

  4. Nature of business of the applicant, e.g. manufacturers, merchants, etc.

  5. Class & specification of the goods on which the mark is applied.

  6. Whether the mark is in use in Pakistan or proposed to be used. If yes, Please specify period/year of use.

  7. Transliteration and translation of non-English works appearing in the mark

  8. Power of attorney duly notarized and signed by the applicant.

Search results need 6-7 working days to be issued.

• Time Frame:

The approximate time frame for completing the registration process of a trademark is 2-3 years.

• Validity:

The duration of a trademark registration is for 10 years from the filing date.

 • Notes:

A separate application is to be filed for each class of goods/services.

If word mark in English language is registered its transliteration is not automatically protected especially as far as visual aspect of mark is concern.

Service marks may be registered according to the 9Th edition of the Nice classification.

• Renewal Requirements:

1- Power of attorney duly notarized and signed by the applicant.

2- Copy of the final registration certificate or last renewal certificate.

• Notes:

Kindly be advised that, the validity of the trademark registration in PAKISTAN is ten years as from the filing date.  Thereafter, a trademark registration is renewable for further consecutive periods of ten years each.  

The renewal fees of a trademark registration can be paid during the last 6 months of the current protection period. There is 4-months grace period starting from the date of publication of the registration in the Trademarks Journal under the heading "Unpaid Renewal Fee”; within which a late renewal application can be filed, but such a late renewal application is subject to the payment of additional fees.

• Requirements for Recordal of Change of name/address/legal status:

  1. A Power of Attorney in the new name and/ or address Duly Notarized & Legalized up to the Consulate of Pakistan.

  2. A certified copy of the Certificate of Change of Name and/ or address Duly notarized & Legalized up to the Consulate of Pakistan.

• Requirements for Recordal of assignment, merger, or license:

  1. A Power of Attorney from the assignee Duly Notarized & Legalized up to the Consulate of Pakistan.

  2. Deed of assignment executed by the parties Duly Notaized & Legalized up to the Consulate of Pakistan.

• Notes:

The agent for service is the only party that has the right to take actions in respect of a trademark; thus, the change of agent name and address is automatically recorded while providing a POA for  the service in question.
