MOROCCO

• Filing Requirements:

1- A simply signed power of attorney for each application.

2- The name, address, and nationality of the applicant and the nature of its business.

3- The list of the goods to be covered by the application.

4- 15 prints of the trademark (not exceeding 8x8 cm) and printing block, which may be obtained locally.

5- A certified copy of the basic registration if convention priority is to be claimed to be submitted within 3 months of filing.

N.B:

Kindly note that all original documents must be submitted within three months as of the filing date. Please be advised that if the three months deadline is not met no extensions will be granted and the application will be automatically canceled.

• Time Frame:

The approximate time frame for completing the registration process of a trademark in Morocco is from 4-5 months. 

• Validity:

A trademark registration is valid for ten years from the date of filing the application.

 • Notes:

Once a trademark is filed it will then be published electronically within two weeks.

A period of two months is allowed for a third party to oppose the application as of the publication date.

If no opposition is filed the registration certificate will take 3-4 months to be issued.

Once a trademark (word mark in English Language) is registered, its transliteration is automatically protected.

Services marks may be registered according to the 9Th edition of the Nice Classification.

An application can be filed without its complete original documents.

• Renewal Requirements:

1- A simply signed power of attorney for each application.

2- Copy of the final registration certificate or last renewal certificate.

• Notes:

The validity of the trademark registration in Morocco is ten years as from the filing date.Thereafter, a trademark registration is renewable for further consecutive periods of ten years each. 

The renewal fees of a trademark registration can be paid during the last 6 months of the current protection period. There is a 6-month grace period within which a late renewal application can be filed, but such a late renewal application is subject to the payment of additional fees.

The change of agent name and address is automatically recorded while providing a POA for the  service in question at no cost.
